Communal Fees

Bijeljina Municipal Assembly has adopted the Decision on Communal Fee at its session held on 18th May 2011. This Decision was made pursuant to Article 15 of Law on Communal Activities ("Republic Srpska Official Gazette ", No 11/95, 18/95 and 51/02).This Decision served to specify the obligations of payment of municipal fees due to use of facilities and devices of communal utility, further on to define the basis and benchmarks to calculate the amount of the communal fee, and the use of funds collected due to communal fees at the area of Bijeljina municipality.

Payers of communal fees are the following: 
- holders of property rights, rights to dispose of or use (temporarily or permanently) a residential, commercial or another premise; 
- users of a constructed facility, with or without a building permit, which has been fully constructed; and 
- tenants as temporary occupants of the premise.

(Another premise, as to this Decision, is considered a garage, as well as auxiliary premises, social standard facilities, courtyards, economic and such facilities.)
 

The basis for calculation of communal fees is a unit of constructed usable surface (m²) with residential, commercial and other premises.

Criteria for communal fee payment are the following: 
- the extent of equipment availability in resided areas as to communal facilities and devices of communal utility; and 
- the planned scope and quality of services and maintenance of communal facilities and devices of communal utility.

The amount of communal fee is calculated per unit of constructed usable surface of ​​residential, commercial and other premises, depending on the zone where the building is located and on the level of equipment availability in resided areas as to communal facilities and devices of communal utility, and it equals as follows, on a monthly basis:

With residential buildings:

Communal fees for production facilities and facilities of general social benefit are paid in the amount of 30% of the fee applicable to certain zone and specified for commercial buildings.

Communal fee for ancillary premises within commercial facilities is paid in the amount of 30% of the fee applicable to certain zone and specified for commercial buildings.

Communal fee for other premises, which include auxiliary facilities, garages and the like, shall be paid in the amount of 50% of the fee applicable to certain zone and specified for payment within the residential category.

Communal fee funds are collected and compiled on a special account.

Communal fee proceeds can be used solely for funding the communal utilities, following the Programme of Maintenance and Modernization of Communal Facilities and Communal Utility Devices.

The amount of the communal fee is determined by the city governance body in charge of housing-utility affairs, issuing a decision thereon.
 

Method of communal fee payment is determined applying the following criteria:

- with total monthly amount under the decision being BAM 10.00 and higher, payment is made ​​by the end of the month for current month; 
- with total monthly amount under the decision being lower than BAM 10.00, payment is made ​​by the end of the calendar year.

If the decision specifies the total monthly amount to be lower than BAM 0.45, the decision shall not be delivered to such customers.

In the event of delayed payment, interest rate will be calculated in accordance with the Law, and the City shall implement its claims through a procedure of enforced collection or in another prescribed manner.

An appeal against the decision is allowed to be submitted at the Ministry of Spatial Planning, Civil Engineering and Ecology; pursuant to new Law on Communal Activities ("Republic Srpska Official Gazette " number 124/11). The appeal shall be submitted through Department of Housing-Utility Affairs and Environmental Protection of Bijeljina City, within 15 days from receipt of the decision.

 

The obligation of communal fee payment does not apply to the following:

- facilities used by individuals or legal entities, which are not constructed ​​with hard materials; 
- facilities serving to perform religious rites, and other assets belonging to religious communities; 
- kindergartens; and 
- persons receiving regular social assistance and users of soup kitchens.
